In Florida, divorce is called dissolution of marriage. A regular dissolution of marriage begins with the filing of a petition for dissolution. The petition is served upon the respondent, and they must file an answer within 20 days. If the parties can agree on issues such as property division, child support and custody arrangements, they can enter into a written agreement that must be accepted by the court. Uncontested divorces such as these may become final in a matter of weeks. Contested divorces can take several months. In the event that the parties cannot agree on the terms of a divorce, the court will make the final judgment.

The grounds for divorce in Florida are:

  • An irretrievable breakdown of the marriage
  • Mental incapacity of one party for at least three years prior to filing the petition for dissolution

At least one spouse must be a resident of Florida for at least six months before filing a petition. The petition must be filed in the county where you lived together as husband and wife or in either party's county of residence.
